Mr. Hayashi Loses Appeal to Use the ARK Name
On April 23, 2009, the Osaka District Court found in favour of ARK and ordered Mr. Hayashi to stop using the name of “ARK Angels.” Mr. Hayashi objected to the Court’s decision and appealed to the Osaka Supreme Court. On March 24, 2010, the Osaka Supreme Court rejected Mr. Hayashi’s appeal.
Both courts have found in favour of ARK and issued decisions that Mr. Hayashi’s use of “ARK Angels” is illegal.
ARK also entered a claim for compensation that, unfortunately, was rejected. However, what was most important to ARK was to receiving a positive decision from the court regarding Mr. Hayashi’s use of the “ARK Angels” name. We do believe that the current decision is appropriate.
Following the decision in the first trial at the Osaka District Court, the domain name “ark-angels.jp” was sold and is currently being used by another person. Thus illegal use of this domain name continues and ARK must pursue this issue with Mr. Hayashi.
